Terms & Conditions

1. General

All goods sold by Arrow Cricket (the Seller) are sold subject to the following Terms and Conditions, except where otherwise agreed to in writing. These Terms and Conditions are binding upon both the Purchaser and the Seller.

 

2. Acceptance

These Terms and Conditions are deemed accepted by the Purchaser upon the earliest of the following:

a) the Purchaser places an order with the Seller; or
b) the Purchaser makes any payment, whether in full or partial.

 

3. Price

3.1 All prices published by the Seller are inclusive of GST.

3.2 Unless otherwise expressly stated, prices do not include freight, delivery, insurance, or any other additional charges incurred between the time of purchase and the receipt of goods.

3.3 The Seller reserves the right to alter published prices at any time without notice. Only the price current at the time of purchase will be honoured.

 

4. Terms of Payment

4.1 Full payment, including any additional charges, is required at the time of purchase. No order will be processed or delivered until payment has been received in full.

4.2 The Seller may, at their sole discretion, agree in writing to alternate payment terms.

4.3 Where such terms are agreed, goods will not be processed or delivered until full payment has been received.

 

5. Ownership

Ownership of goods passes from the Seller to the Purchaser at the earlier of:

a) dispatch of goods for delivery; or
b) collection or possession of goods by the Purchaser.

Goods are considered dispatched once they are in the physical possession of a courier or delivery agent.

 

6. Delivery

6.1 Delivery charges are payable by the Purchaser and are in addition to the purchase price, unless waived by the Seller.

6.2 While reasonable efforts will be made to ensure goods arrive undamaged, the Seller accepts no liability for damage or loss during transit.

6.3 Delivery times are estimates only. The Seller is not liable for any delay or loss resulting from late delivery.

 

7. Returns

7.1 Goods may be returned within 30 days of purchase for store credit, provided they are:

  • unused,

  • in original condition,

  • accompanied by proof of purchase and a reason for return.

7.2 Store credit will be issued only if goods meet the return conditions.

7.3 The Purchaser is responsible for return shipping costs.

7.4 If a return is denied, the goods will be returned to the Purchaser at the Seller's expense.

7.5 The Seller accepts no liability for damage or loss during return shipping.

7.6 For faulty or defective goods, warranty provisions apply (see section 8).

 

8. Warranties

8.1 All goods are sold with non-excludable guarantees under Australian Consumer Law. These include that goods are:

  • fit for purpose,

  • of acceptable quality,

  • safe,

  • free from defects, and

  • as described or demonstrated.

8.2 In addition to statutory rights, the Seller warrants that goods are free from defects for 30 days from the date of purchase.

8.3 Faulty goods returned within 30 days may be eligible for a refund, exchange, or store credit.

8.4 The Seller will inspect and determine whether goods are faulty.

8.5 The Purchaser bears the cost of returning goods under warranty claims.

8.6 If a fault is confirmed, the Seller will reimburse reasonable return shipping costs.

 

9. Force Majeure

The Seller shall not be liable for failure to perform obligations where such failure is due to causes beyond reasonable control, including but not limited to:

  • natural disasters,

  • pandemics,

  • strikes or industrial disputes,

  • power or internet failure,

  • civil unrest,

  • acts of terrorism or war,

  • government actions, or

  • other events beyond the Seller’s control.

In such cases, the Purchaser is entitled to a full refund.

 

10. Waiver

No waiver of any term or breach of these Terms and Conditions shall constitute a waiver of any other term or any subsequent breach.

 

11. Severance

If any provision of these Terms and Conditions is deemed unlawful or unenforceable, it shall be severed, and the remainder shall remain in full force and effect.

 

12. Governing Law

These Terms and Conditions are governed by the laws of Australia. Any disputes arising under them shall be subject to the exclusive jurisdiction of the Australian courts.
